In French administrative courts, the clearance rate was higher than the European median for second instance courts, but lower for the first instance and supreme courts in 2020. Indeed, the clearance rate in administrative courts of second instance was 101.6 percent in France, compared to the European median of 100.9 percent.
In addition, a clearance rate exceeding 100 percent means that the court is able to resolve more cases than it has been seized with, and thus that the backlog of cases is decreasing. The backlog of cases was therefore greatest in first instance administrative courts in Europe in 2020.
